Commentary by Attorney Michael Grossman
While the cause of the accident isn’t clear right now, the reality of Texas work fatality law is that it’s more complex than in any other state in the country. This is due to the fact employers are not required to subscribe to the workers’ comp system. People tend to assume families have benefits that automatically come to them after these kinds of accidents. But for some, there is no guarantee. This can create situations where a worker’s family, in serious need of assistance, must work to get that assistance from a company that isn’t likely going to have their best interests at heart. That’s why, regardless of what led to this accident, there’s likely a legal maze ahead for those involved that may take significant experience and effort to properly navigate.
