How Did This Accident Occur?

A lot of people see rear-end collisions and automatically assume the rear driver is at fault. That’s actually one of the myths I deal with the most. There is no law saying you’re automatically responsible for rear-ending someone. Now, is that often true? Absolutely. The most common factors are things like distracted driving, unsafe speed, and following too closely. But what if, for example, someone’s brakes failed. Would it be reasonable for them to be responsible for something they couldn’t foresee or avoid? Of course not.

That’s why I always discourage people from jumping to conclusions in these situations. There could be extenuating circumstances that still need to be investigated. I don’t see any reason right now why this crash would be an exception to that.
