How Did This Accident Occur?
If what authorities say here is accurate, then it seems obvious that alcohol is the likely culprit that caused the crash. However, it might not be the only culprit. I’ve handled hundreds of cases where it was both the alcohol and the way the alcohol was served that led to the accident. Let me explain.
In Texas, our communities recognized that alcohol can be handled irresponsibly not just by those drinking it but also by those serving it. If someone is a clear danger to themselves or others due to their intoxication, it would only cause more danger for alcohol providers to continue serving that person. That’s why our legislature made it unlawful for bars, restaurants, and other providers to over-serve people who are obviously intoxicated. If they do so, and that leads to those people harming themselves or others, then the alcohol provider can be held responsible for their role in that harm.
Even when a crash happens earlier in the day like this one did, it’s important to find out if an alleged drunk driver was unlawfully over-served. No doubt a lot of folks have been at a brunch or lunch spot and seen someone stumble from their table after having way too much. It’s important that investigations determine one way or the other if something like that happened here. If so, then there should be appropriate consequences for all parties who made mistakes and contributed to the crash.
