How Did This Accident Occur?

When it comes to pedestrian-involved car accidents, lots of folks make the assumption that it comes down to a single question: who had the right-of-way at the time of the accident? I’m not going to pretend that that is not an important question, but after over thirty years in this career I have learned that it is far from the only question that investigators should be asking. Was there enough pedestrian infrastructure in the area, like crosswalks and sidewalks? The collision happened later at night; what is the lighting like? What about the vehicle itself? What kind of condition was it in? Should it have been able to avoid hitting the victim? Or was there some sort of mechanical malfunction or product defect like brake failure or steering column issues? Was driver error—like distraction, fatigue, or impairment—at play? Hopefully investigators—whether the authorities or a third party—are meticulous and openminded enough to get to the bottom of it. After all, the love ones left behind by the victim deserve more than just vague assumptions based on surface-level investigation.
