Accident Report

September 18, 2026, Officer Josiah Baxter and one other were injured after an alleged drunk driver accident after midnight on East Commerce.

Authorities reported that the incident began outside of a restaurant off the corner of East Erwin Street and South Beckham Avenue. Reports allege that a 21-year-old and a passenger were in a vehicle that sped away from the restaurant. At East Commerce Street and North Virginia Avenue, that vehicle reportedly crashed into a Tyler PD patrol vehicle driven by Officer Josiah Baxter.

Due to the crash, Officer Josiah Baxter and the passenger from the other vehicle were seriously injured. The 21-year-old driver of that vehicle was accused of driving under the influence of alcohol. Currently, that driver appears to face a charge for intoxication assault.

Investigations are ongoing.

How Did This Accident Occur?

If the allegations are true, then alcohol definitely would explain some of the alleged behavior leading up to this crash. In fact, it reminds me of an awful situation here in DFW some years ago where a drunk driver t-boned a Euless Police officer and his family.

What stood out was that investigations found the driver was coming from a local restaurant after being unlawfully over-served. I wonder if anything similar happened here? Reports say this began outside of a local restaurant. Was the alleged drunk driver served there? Are authorities investigating that establishment or any others for potentially breaking the law and contributing to this accident?

I’d hope that any serious drunk driving crash would call for investigations into where the alcohol came from and if there are any accomplices to the crash. Hopefully continued efforts, either from authorities or independent professionals, will bring all that to light in due time.
