Commentary by Attorney Michael Grossman

It obviously raises serious red flags that OSHA alleges they found multiple serious violations following this accident. What’s important to note, however, is that even if those allegations are true, that doesn’t necessarily guarantee any sort of just resolution for the victim’s loved ones. Let me explain why that is.

Texas has the most complex work fatality laws in the country. Despite what many think, there isn’t always an automatic process for a worker’s family to receive benefits or directly confront an employer following an accident. Instead, some families are left at the whims of those employers, whose number one priority is usually to avoid as much responsibility as possible.

As such, deadly work accidents in Texas often need thorough investigations independent of OSHA. That way, there can be efforts to get answers which prioritize the needs of the family rather than just looking for administrative penalties. Taking these steps can make the difference between a family getting the resolution they deserve and a family being left in the dark at a time of indescribable loss.
