Commentary by Attorney Michael Grossman
After all these years, I still constantly have to deal with the old misconception that someone is automatically responsible for rear-ending another vehicle. To be clear, I don’t have any information on what did or didn’t happen in this crash. But just because the victim hit a truck from behind doesn’t make things open-and-shut. In fact, the victim not being around to give their side of the story can make things very challenging. It’s important that crashes like this get as much attention from accident reconstructionists as possible. Even unlikely possible factors should be considered before people start trying to jump to conclusions. Are those steps being taken here?
