How Did This Accident Occur?
A landscaping accident can involve all kinds of unique factors, but I don’t want to speculate while there’s so little information available. Instead, I want to highlight something that’s been consistent between just about every fatal work accident case I’ve handled across nearly 40 years. That fact is that a worker’s family usually has to go out of their way to advocate for their own needs.
Authorities, including OSHA, have their own goals. Their efforts usually revolve solely around those goals. Meanwhile, families are left to navigate the most complex work accident laws in the whole country, which do not always guarantee a smooth or automatic solution. So, regardless of what happened here, my hope is steps were taken early to look out for the family’s interests and ensure evidence is being preserved. Otherwise, authorities could leave families with as little information as they’ve given to the public so far.
