How Did This Accident Occur?

Considering this is a rear-end collision, folks might think this is an open-and-shut question. If someone rear-ends another vehicle, they’re automatically at fault, right? That’s not actually true. In fact, it’s the most common misconception I deal with even after a more than 30 year career.

Simply put, there is no automatic responsibility for a crash like this. It is true that most common factors trace back to the rear driver making a mistake. For example, cellphone use and speeding are quite common. So are following too closely, intoxication, and fatigue. However, let’s say, hypothetically, a truck didn’t have working brake lights. That could explain a driver not knowing to slow down until it’s too late. Or what about a mechanical issue leading to brake failure? That isn’t always foreseeable, and it would call for careful inspections of the brakes to see if a manufacturing defect led to the accident.

Likely or not, investigations need to consider all of these factors so there can be clear answers before anyone draws conclusions. Jumping to blame someone never really did any good, anyway. So, hopefully steps will be taken here not to look for blame but rather to focus on gathering the facts.

Has anyone ever been involved in a rear-end collision they couldn’t avoid? Tell me about the experience in the comments.
