Commentary by Attorney Michael Grossman
If it’s true the truck involved in this was parked in a lane of travel, it’s important to clarify some key points. Did the truck have its lights on? Was it disabled? If so, was it due to sudden, unpredictable mechanical issues, or the result of something foreseeable related to poor maintenance? Did the truck have reflective cones or markings nearby? Were other drivers able to see and avoid the truck without any issues? How long had the truck been there?
People sometimes see that a vehicle was “stopped” and think that means all of the focus should automatically go to the other driver. In reality, the actions of both drivers still need to be considered to get a complete picture of what went wrong and how the crash could have been avoided. If authorities have been too one-sided in their efforts, they might have overlooked something important.
