Commentary by Attorney Michael Grossman

One of the unique things about passengers involved in a crash is that it’s almost guaranteed someone is responsible for the harm done to them. After all, unless a passenger reaches over and yanks the steering wheel, there aren’t many ways they can cause a crash.

That’s why it’s important investigators consider even unlikely possible contributing factors. Vehicle speeds, distracted driving, alcohol, road design, faulty seatbelts or airbags—even if it’s just to rule something out, investigations should be thorough. That way, the victim has as much evidence as possible telling their side of the story.
