Commentary by Attorney Michael Grossman
Frankly, it would be more surprising if alcohol wasn’t a factor here. If the allegations turn out to be true, it would be yet another wrong-way crash involving an intoxicated driver. That said, having an obvious wrongdoer and even filing charges likely wouldn’t be the end of the story. Most wrong-way crashes involve extremely intoxicated drivers, and that calls for questions into where that alcohol came from.
Here’s why that matters. A lot of crashes like this happen after a negligent bar or other establishment unlawfully over-serves a driver to the point they’re unaware of their surroundings. In Texas, alcohol providers can be held accountable when they over-serve someone who goes on to get people hurt or killed. Not only does this help to see there are consequences for the harm done to victims and their families, but it also helps set those negligent alcohol providers on the straight-and-narrow before more people are hurt.
Unfortunately, this is an area of the law that rarely gets the attention it deserves. Authorities often move on once there’s someone facing charges. But so long as a negligent alcohol provider is allowed to continue over-serving patrons, these wrong-way accidents are bound to keep happening. That’s why it’s important that all parties responsible for a wrong-way crash face the appropriate consequences.
