How Did This Accident Occur?

With pedestrian accidents, I find that people often hold one of two assumptions. The first one I see is that pedestrians always have the right-of-way. The second is that unless the pedestrian was in a crosswalk, they’re automatically at fault. The truth is somewhere in-between.

To put it simply, the law focuses on whether or not the collision was reasonably avoidable, and how it could have been avoided. For example, if someone is in the middle of the road with no crosswalk, but they’re clearly visible and far away enough to avoid, a driver hitting them would raise serious red flags about why that driver failed to see and avoid them. Alternatively, if a driver couldn’t have had enough time to see and avoid the pedestrian, it would be ridiculous to hold them responsible for that.

So, investigations here will have to map out where the collision happened, what visibility was like, how fast the vehicle was going, whether or not cellphone use was a factor, whether drugs, alcohol, or some medical condition contributed to the situation, etc. Once all of the evidence is clear, it can give a nuanced explanation of what happened here and how, if at all, it could have been avoided.
