Commentary by Attorney Michael Grossman
People tend to think of car crashes only in terms of drivers versus other drivers. But when all the victims are just passengers along for the ride, the focus needs to be more broad than just looking for a driver to blame. While things like distraction, alcohol, speed, and fatigue are always important to consider, accident reconstructions also need to inspect for defects, look at road conditions, examine road design, and consider other possible external factors.
At the end of the day, it’s highly unlikely for a passenger to ever be responsible for a crash like this. But that doesn’t mean things are open-and-shut. It’s just as important for a crash like this to receive careful, thorough accident reconstructions as it is for a multi-vehicle high speed pile-up. What matters is that the victims and families involved know they’re getting the full story.
