Commentary by Attorney Michael Grossman
People generally just think of car accidents as being drivers versus drivers. But when a passenger is the only one injured in a crash, it can throw people off. Generally speaking, though, the law is pretty straight-forward.
Whoever’s actions were more likely than not the proximate cause of the victim’s injuries is the one who will generally have to take responsibility. That goes for drivers in other vehicles as well as drivers in the same vehicle as the victim. In fact, responsibility is often spread between the two drivers based on their respective actions.
As straight-forward as the law may be on paper, though, actually handling and preserving evidence is anything but. That usually takes extensive and careful investigations that go beyond just a cursory glance of the crash scene. The sooner investigators work to gather clear evidence, the better the chances victims and families will see a fair resolution.
