Commentary by Attorney Michael Grossman
If evidence confirms that alcohol is a factor here, people might think that makes a situation open-and-shut. In reality, that can make things quite a bit more challenging. This is because many alcohol-related accidents involve negligent alcohol providers who over-serve those drivers. Those alcohol providers may also have consequences to face, in the form of potential criminal investigations, fines, suspended licenses, or liability for the resulting injuries.
Too often, though, these negligent alcohol providers fly under the radar. I’ve had hundreds of cases against negligent alcohol providers who contributed to a serious accident. It’s not at all unusual for families to come to us, we do our own investigations, and we find that authorities moved on after charging the drunk driver without ever bothering to find out where the alcohol came from. Not only does this leave victims and families with an incomplete story, it allows those negligent alcohol providers to continue being reckless unchecked.
So while exact details surrounding this accident aren’t entirely clear right now, there are some familiar red flags which make me wonder if the investigations have been handled appropriately. There could still be more to this story than those affected by the crash realize.
