Commentary by Attorney Michael Grossman
Just because OSHA alleges there were rule violations here doesn’t mean that the worker’s loved ones will automatically see a fair resolution for their loss. This is something I have to discuss with folks a lot. Many think there is an automatic process for families affected by a work fatality. That’s not always true.
Texas work fatality law is more complex than in any other state in the country. As such, there can be a significant legal maze between families and the resolution they deserve. Since OSHA generally just focuses on their own priorities, navigating that legal maze typically requires independent professionals experienced with Texas work fatality law. The sooner they have all the facts and can start working on a path forward, the sooner a worker’s family can seek out a solution that’s best for them.
