UPDATE (November 29, 2023): Investigators have released public statements indicating that alcohol consumption may have played a role in this accident.

To be clear, even if these allegations are true, nobody is criticizing the victim. They didn’t get behind the wheel, after all, so it’s not like they did anything wrong. But this new information, if true, reminds me of a wrongful death case I handled, and I can’t help wondering what other similarities there could be.
In that case, a man was hit on the freeway while walking home after a night out, and authorities found that the man was drunk. However, that’s as far as they cared to investigate. The family hired us just because they wanted to be sure they were getting all the facts. Well, it turned out authorities missed a crucial detail.
Evidence showed that the man was illegally over-served by the establishment where he’d been drinking. As a result, he became disoriented while trying to walk home, walked across the wrong roadway, and ended up being hit and killed by a car. What was written off as nothing more than someone being where they shouldn’t have been ended up being a negligent business that opened themselves up to potential criminal charges, civil liability, and administrative penalties through the TABC.
I don’t see any information indicating that happened here, but I have yet to see authorities rule it out, either. It makes me wonder if this is another situation where authorities maybe missed something important.
UPDATE (July 21, 2023): Authorities identified the woman killed in the accident as Ashley Torres. There were no other confirmed details.
Harris County, TX — July 16, 2023, a woman was fatally injured due to a car accident at around 11:00 p.m. along Farm-to-Market 1960.
Authorities with the Harris County Sheriff’s Department said that the fatal incident happened in the Cypress area as a woman was walking along F.M. 1960. While the unidentified woman attempted to cross the roadway, a vehicle struck her while going westbound.
As a result of the collision, the woman hit by the vehicle sustained fatal injuries. The driver was not hurt and remained at the scene. At this time, there is no indication that charges are being considered. Details leading up to the incident are still under investigation.
