Accident Report

September 5, 2026, four pedestrians were injured due to an alleged DWI accident shortly before 1:00 a.m. along West Davis Street.

According to authorities, four people—three women ages 20, 21, and 22, and a 23-year-old man—were attempting to cross the street on foot in the vicinity of the West Davis Street and North Barnett Avenue intersection when the accident took place. Officials indicate that the four pedestrians were struck by a vehicle that had been driven by a 32-year-old man who had allegedly been intoxicated at the time.

All four of the pedestrians were injured, according to reports, and three of them had to be transported to local medical facilities by EMS in order to receive necessary treatment. The 21-year-old woman’s injuries were apparently serious, while the other victims’ injuries were minor. Authorities have reportedly recommended Driving While Intoxicated charges against the 32-year-old man.

Additional details pertaining to this incident—including the identities of the victims—are not available at this point in time. The investigation is currently ongoing.

How Did This Accident Occur?

I have been in this line of work for over three decades. In that time, I’ve had the opportunity to analyze hundreds of intoxication-related accidents. Sometimes, authorities do a great job of remaining meticulous and openminded as they investigate. Other times, not so much. In this particular case, I hope they don’t get too tied up in focusing on the collision itself, though I certainly don’t want to minimize its importance; but there are other questions that really need to be addressed. One of those questions is whether or not the driver was intoxicated by alcohol.

You might be wondering why that would be important. Well, if he had been driving drunk, then there is the possibility that there were people who played a role in the wreck who had not even physically been at the scene. How’s that? Allow me to suggest a hypothetical. What if the man had been drinking at an establishment that serves alcohol—such as a restaurant, bar, or club, for example? If he was, then there is a chance that he had been overserved. If that does turn out to have been the case, then the person(s) who continued to serve him drinks even after he was obviously intoxicated hold a not insignificant portion of responsibility for what happened in the accident.

So what can be done about it? Well, Texas has a tool known as Dram Shop Law; it allows for establishments to be held accountable for their role in accidents caused by their overserved customers in which someone is seriously injured or killed. To be clear, this does not mitigate the importance of the driver’s decision to get behind the wheel when he shouldn’t have. However, for those affected by accidents like this one, ensuring that everyone who played a part in the wreck is held accountable can do a lot to help. That can only happen if investigators find out whether or not overservice was a factor.
